Abstract
Korea has dualistic medical system ensuring the practice of medical doctor and oriental medical doctor. In other words, Korean medical system is being divided medical science and Korean traditional medical science since 1951. In accordance with this system, medical doctors can not practice oriental medicine. On the contrary, oriental medical doctors can not practice (western) medicine. If doctor who has acquired licence in one sector does practice of the other sector, he or she can be clobbered with the unlicensed practice.
Recently, legal disputes between medical doctors and Korean traditional medical doctors are occurring often violate the job definition. Especially, it is very controversial whether one sector can use the other sector"s medical devices or not. For example, there are CT(Computer Tomography), IPL(Intensive Pulsed Light) and IMS(Intramuscular Stimulation Therapy), and so on. In this article, we have examined thoroughly the legal issues on the conflict cases between medical doctors and oriental medical doctors. Practice of medicine and practice of oriental medicine can be generally defined and distinguished by its academic principles. This criteria is, however, so vague that we have no choice but to try to detect the additional review. And it is not easy to make division clear between western medicine and oriental medicine. Furthermore, these divisions may be restricted to prevent health care providers from practice. Meanwhile, we study on the limits and the applicative range of medical devices Share.
In the end, we must endeavor to devise the harmonious means, the ambiguous concept of academic principles, the development in medical technology. If it"s difficult to make division clear between western medicine and oriental medicine, and there are hefty side effects by the conflict of both sides, it is keenly necessary to discuss the unification much more widely.
